If you do not agree to all of these terms, you must not access or use the Service. Your continued use of the Service constitutes your acceptance of these Terms and any future modifications.
You must be at least 18 years of age to use this Service. By using WireMuse, you represent and warrant that you are at least 18 years old. We do not knowingly allow individuals under 18 to use the Service. If we discover that a user is under 18, their access will be immediately terminated.

Moderated Room: Nudity and sexually explicit content are strictly prohibited. Violations will result in suspension or permanent ban.
Unmoderated Room: Adult content may be permitted between consenting adults. However, all other prohibited activities (illegal content, harassment, content involving minors, etc.) remain strictly forbidden and will result in immediate permanent ban.
Users may report other users for violations of these Terms. When a report is submitted:
False Reporting Penalty: Users who submit false or frivolous reports may be designated as "unreliable reporters" and face temporary restrictions on their ability to use the Service. Repeated false reports may result in permanent ban.
We reserve the right to suspend or terminate your access to the Service at any time, without prior notice, for any reason, including but not limited to:
Suspensions may be temporary (affecting access to moderated rooms, unmoderated rooms, or both) or permanent (complete ban from the Service). We are under no obligation to provide reasons for suspension or termination, nor to restore access.
While we cannot control the actions of individual users during live interactions, we employ automated moderation systems and community-driven reporting mechanisms designed to identify and restrict users who violate our Community Guidelines. Users who engage in prohibited conduct may experience progressively restricted access to the Service, including reduced matching availability, temporary suspension from specific rooms, or permanent removal.
These measures are applied at our sole discretion and are designed to protect users who follow the rules, ensuring they can enjoy the Service in a safe and respectful environment.
WireMuse offers optional premium features through a digital token system ("Premium Tokens"). By purchasing Premium Tokens, you agree to the following:
Payment processing is handled by Stripe, a third-party payment processor. Your payment information is processed directly by Stripe and is never stored on our servers. By making a purchase, you also agree to Stripe's terms of service and privacy policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We make no guarantees regarding the conduct of other users or the content they may share.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WIREMUSE, ITS OPERATORS, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR:
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR TEN DOLLARS ($10.00 USD), WHICHEVER IS GREATER. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

The Service, including its original content, features, and functionality, is owned by WireMuse® and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
Trademark Notice: "WireMuse" and the WireMuse logo are registered trademarks with the Mexican Institute of Industrial Property (IMPI). Unauthorized use of these trademarks is strictly prohibited and may result in legal action.

Your use of the Service is also subject to the terms and privacy policies of these third-party services. We are not responsible for the practices of these third parties.
These Terms and Conditions shall be governed by and construed in accordance with the laws of Mexico, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts of Mexico. By using the Service, you consent to the personal jurisdiction of such courts, regardless of your location.
TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against WireMuse.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and WireMuse regarding your use of the Service and supersede all prior agreements and understandings.
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of WireMuse.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service, including the determination of the scope or applicability of this agreement to arbitrate, shall be resolved by binding arbitration administered in accordance with the laws of Mexico.
The arbitration shall be conducted by a single arbitrator in Mexico City, Mexico. The language of the arbitration shall be Spanish or English, at the arbitrator's discretion. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
WAIVER OF JURY TRIAL: BY AGREEING TO THESE TERMS, YOU WAIVE YOUR RIGHT TO A JURY TRIAL FOR ANY DISPUTES ARISING FROM YOUR USE OF THE SERVICE.
You may opt out of this arbitration agreement by notifying us in writing within 30 days of first using the Service. However, given the anonymous nature of the Service, such opt-out may not be verifiable.
WireMuse shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to:
During any such event, our obligations shall be suspended for the duration of the event. We make no guarantees regarding uptime, availability, or continuous operation of the Service.
WireMuse respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and similar international laws, we will respond to valid notices of alleged copyright infringement.
Safe Harbor: As a service provider that allows user-generated content (video streams, chat messages, drawings), WireMuse qualifies for safe harbor protection under 17 U.S.C. § 512 and equivalent international provisions. We do not pre-screen content and are not liable for infringing content transmitted by users.
User Responsibility: You are solely responsible for any content you transmit through the Service. You represent and warrant that you have all necessary rights to transmit such content and that it does not infringe any third-party intellectual property rights.
Termination for Repeat Infringers: We reserve the right to terminate access for users who are determined to be repeat infringers of copyright or other intellectual property rights.
Due to the anonymous and real-time nature of the Service, we do not maintain a formal DMCA takedown process. Content is not stored or indexed in a manner that would allow for traditional takedown procedures.
